Australia’s life insurance industry has moved mental health cover back to the centre of the affordability debate, after the Council of Australian Life Insurers released its response on 30 September 2026 to the independent review of the Life Insurance Code of Practice.
For workers who rely on income protection insurance, the issue is practical: mental health conditions can affect earning capacity just as seriously as physical illness, but changes designed to keep premiums manageable may also alter what is covered.

The industry response follows the final report from independent reviewer Peter Kell, which made 85 recommendations covering mental health, claims handling, First Nations customers, funeral insurance, vulnerability support and code oversight. CALI has said more detailed work will now continue through priority workstreams, with mental health one of the most complex areas to be considered before final drafting of an updated Code.

The key tension is choice versus protection. CALI has supported the principle that standard-form disability insurance contracts should not automatically exclude all mental health conditions. At the same time, it has argued consumers should be able to modify cover, including potentially opting out of mental health cover for affordability reasons, provided the choice is informed, voluntary and supported by safeguards. That distinction matters because a cheaper policy can become far less useful if a common cause of incapacity is restricted or excluded.

For income protection customers, the debate is not only about headline exclusions. Mental health cover can also be affected by benefit design, evidence requirements, waiting periods, benefit periods, caps, definitions of disability and how recurring or episodic conditions are assessed. A policy may appear broad at first glance, while the detail sits in the policy terms.

Consumers reviewing existing or future cover may wish to look closely at:

  • whether mental health conditions are covered in the same way as physical illness or injury;
  • any specific exclusions, limits or shorter benefit periods that apply;
  • what medical evidence may be required at claim time;
  • whether premium savings from reduced cover are worth the potential gap;
  • how the policy interacts with sick leave, workers compensation, superannuation insurance or other benefits.

It is also important not to assume the industry response has already changed every policy. The Life Code process still involves further work, consultation and drafting, and individual insurers may have different product settings. The useful takeaway is that mental health cover is becoming a sharper test of transparency. Affordability matters, but so does understanding exactly what income protection will and will not do if illness interrupts work.
